Google, as a third-party vendor, uses cookies to serve ads on our site. Google's use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet.

We do not specifically market to children under the age of 13 years old.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

We will notify affected individuals once our response team has investigated and determined the cause of the breach and what was gathered.

We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non- compliance by data processors.

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions
  • Process orders and to send information and updates pertaining to orders.
  • Send you additional information related to your product and/or service
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CANSPAM, we agree to the following:

  • Not use false or misleading subjects or email addresses.
  • Identify the message as an advertisement in some reasonable way.

Family Educational Rights and Privacy Act (FERPA)

The Family Educational Rights and Privacy Act (FERPA) grants eligible students certain rights regarding their education records. An “eligible student” under FERPA is defined as a student who is either 18 years of age or older, or who attends a postsecondary institution at any age.

The right to inspect and review the student's education records: Students have the right to review their education records within 45 days of submitting a request for access to ProTrain. To initiate this process, the student must provide a written request to the registrar, dean, or head of the academic department, specifying the records they wish to inspect. The school official will then arrange access and notify the student of the time and place for record inspection. If the records are maintained by a different official, the student will be directed to the appropriate person.

The right to request an amendment to the student’s education records: If a student believes that their education records are inaccurate, misleading, or violate their privacy rights under FERPA, they may request an amendment. The student should submit a written request to the registrar, clearly identifying the specific part of the record they want changed and the reasons for the change. If ProTrain declines the request for amendment, the student will be informed in writing and advised of their right to a hearing regarding the amendment request. Additional details about the hearing procedures will be provided at that time.

The right to provide written consent before the disclosure of personally identifiable information (PII): ProTrain must obtain a student's written consent before disclosing PII from the student’s education records, except in circumstances authorized by FERPA where disclosure without consent is permitted.

Exceptions to the consent requirement for disclosure of education records: ProTrain may disclose education records without prior written consent under FERPA’s exception for disclosures to school officials who have legitimate educational interests. A school official can include:

  • An employee in an administrative, supervisory, academic, research, or support staff position (including health or law enforcement personnel).
  • A member of the board of trustees.
  • A student serving on an official committee, such as a disciplinary or grievance committee.
  • Contractors, consultants, volunteers, or other parties providing services or functions on behalf of the school, under the school's direct control concerning PII use and maintenance.

Disclosure to other educational institutions: Upon request, ProTrain may disclose education records without consent to officials of another school in which a student seeks or intends to enroll.

The right to file a complaint: Students may file complaints with the U.S. Department of Education regarding alleged failures by ProTrain to comply with FERPA requirements. Complaints should be directed to the Family Policy Compliance Office, U.S. Department of Education, 400 Maryland Avenue, SW, Washington, DC 20202.

Directory information: Certain information may be released without the student’s written consent. ProTrain defines directory information as:

  • Name
  • Address
  • Telephone number
  • Major field of study
  • Dates of attendance
  • Degrees, honors, and awards received
  • Participation in recognized activities and sports
  • Email address
  • Grade level
  • Most recent educational institution attended
  • Course credit load

Permissible disclosures without student consent under specific conditions (FERPA regulations § 99.31): FERPA allows the disclosure of PII from education records without the student’s consent if certain conditions are met, such as:

  • To other school officials within ProTrain who have a legitimate educational interest. This can include contractors, consultants, or volunteers performing institutional services. (§ 99.31(a)(1))
  • To officials of another school where the student is enrolling, for purposes related to enrollment or transfer. (§ 99.31(a)(2))
  • To authorized representatives of the U.S. Comptroller General, the U.S. Attorney General, the U.S. Secretary of Education, or State and local educational authorities for audit or compliance purposes. (§§ 99.31(a)(3) and 99.35)
  • In connection with financial aid, if necessary for determining eligibility, amount, or enforcement of aid terms. (§ 99.31(a)(4))
  • To organizations conducting studies on behalf of the school to improve instruction, administer aid programs, or develop predictive tests. (§ 99.31(a)(6))
  • To accrediting organizations for accrediting purposes. (§ 99.31(a)(7))
  • To parents of a student who is claimed as a dependent for IRS tax purposes. (§ 99.31(a)(8))
  • To comply with a judicial order or lawfully issued subpoena. (§ 99.31(a)(9))
  • To appropriate officials during health or safety emergencies. (§ 99.31(a)(10))
  • Disclosure of information classified as "directory information" by the school. (§ 99.31(a)(11))
  • To victims regarding the results of disciplinary proceedings related to crimes of violence or non-forcible sex offenses. (§ 99.31(a)(13))
  • To the general public regarding final results of disciplinary proceedings if the student is found to have committed a crime of violence or non-forcible sex offense. (§ 99.31(a)(14))
  • To parents concerning a student's violation of laws or school policies on alcohol or controlled substances if the student is under 21. (§99.31(a)(15))
